The officers were patrolling the Wilmington area. The officers’ attention was drawn to a white Honda Accord being driven by a male Hispanic, subsequently identified as Carnelio Quinones, 25 years of age, a resident of San Pedro. The officers had received information at a roll call briefing, earlier that day, relative to a murder suspect who was driving a white Honda Accord. The officers activated their emergency lights in an attempt to stop the suspect but Quinones failed to comply. Quinones slowed his vehicle, opened the driver’s door and ran from the vehicle as it continued rolling west. The vehicle stopped when it struck a parked car. Suspect Quinones ran southbound through the houses. The officers pursued Quinones on foot to a driveway on the west side of an apartment building located on the southwest corner of McDonald Street and D Streets. Officer Boccanfuso began searching the driveway area with his weapon drawn. Suddenly, Quinones lunged from the vicinity of a trash container and grabbed Officer Boccanfuso’s weapon. Officer Boccanfuso wrestled the weapon away from Quinones. Quinones attempted to grab the weapon again. Officer Boccanfuso, in fear for his life, fired one round, striking Quinones in the left hand. Quinones was taken into custody.
