Los Angeles: A man transported to Topanga Area Police Station for a Private Person Arrest, suddenly kneed one of the officers after getting out of their patrol car.
On July 10, 2011, at around 8:40 p.m., Topanga Area Patrol Officers were called to the 22000 block of Sherman Way for a “Disturbing the Peace” investigation. The person reporting the incident made a Private Person’s Arrest of 31-year-old Barry McGowen. The officers took McGowen into custody for Disturbing the Peace and Challenging to Fight.
The officers transported him to Topanga Area Police Station for booking. When the suspect got out of the police car he used his knee to strike one of the transporting officers, hitting him in the upper thigh. McGowen continued to struggle with the officers and was taken to the ground in an attempt to subdue him. McGowen struck his head on the pavement and temporarily lost consciousness.
The Los Angeles City Fire Department personnel responded and transported McGowen to a local hospital where he was treated for his injury and held for observation. None of the officers were injured in the incident.
McGowen was subsequently arrested for Battery on a Police Officer and released pending his court date.
LAPD’s Force Investigation Division (FID) is investigating the use of force incident and Topanga Area Detectives are investigating the ‘Disturbing the Peace’ and ‘Battery Against a Police Officer’ crimes.
